These Terms are the agreement between you and [PLACEHOLDER: legal entity name] ("Ballpoint", "we", "us") for use of the Ballpoint app and related services (the "Service"). Please read them — by using Ballpoint you agree to them.
1. Acceptance
By downloading, signing in to, or using Ballpoint, you confirm you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service. You must be at least 16 years old to use Ballpoint.
2. The Service
Ballpoint lets you point your camera at handwritten notes, sketches, receipts and documents — or import photos, PDFs and spreadsheets — and turn them into professional paperwork such as branded quotes and invoices, or AI-generated drawings. It uses AI to read your captures and draft the content; you then review, correct and send. The Service works offline and can back up and restore your content when you're signed in.
Ballpoint is a tool for making paperwork — it is not job-management software. It deliberately does not provide scheduling, dispatch, CRM pipelines, timesheets or chat.
We may improve, change or add features over time. We'll try not to break things you rely on, but the Service is provided on an ongoing, evolving basis.
3. Your account
You're responsible for keeping your sign-in secure and for activity under your account. Sign-in is provided through Apple, Google or email. Let us know at [email protected] if you think your account has been compromised.
4. Subscriptions, free trial and billing
Free trial. New users get a 15-document free trial. The trial is measured by documents, not by time — it doesn't expire after a set number of days. You can create up to 15 documents before you need to subscribe.
Subscription. After the trial, continued use of document creation requires a paid subscription — one flat monthly price for unlimited documents and scans, with no per-user fees.
Billing and auto-renewal. Subscriptions are sold as in-app purchases through the App Store or Google Play and managed for us by RevenueCat. Payment is charged to your app store account at confirmation of purchase. Your subscription automatically renews each period unless you cancel it at least 24 hours before the end of the current period. Your app store account is charged for renewal within 24 hours before each period begins.
Cancelling. You can cancel any time through your App Store or Google Play account settings. Cancellation stops future renewals; it takes effect at the end of the current paid period. Refunds are handled by Apple or Google under their store policies, not by us.
Prices. Prices may change; we'll give notice as required, and any change applies to future billing periods, not retroactively.
5. Acceptable use
You agree not to:
- use Ballpoint for anything unlawful, fraudulent, or misleading — including creating documents intended to deceive;
- upload content you don't have the right to use, or that infringes someone else's rights;
- upload malware, or attempt to break, overload, reverse-engineer or gain unauthorised access to the Service;
- resell, sublicense or misrepresent the Service; or
- use the Service to build a competing product from our data or models.
6. Your content is yours
You keep all rights to the content you put into and create with Ballpoint — your captures, quotes, invoices, customers, price book and generated documents and drawings. We don't claim ownership of it.
You grant us only the limited permission we need to run the Service for you: to store your content, back it up when you're signed in, and send your captures to our AI provider to extract data and generate your paperwork and drawings, as described in our Privacy Policy. You're responsible for the content you upload and for the documents you send to your customers.
You can export all your content for free at any time, and delete it whenever you choose.
7. AI output — check everything before you send
Ballpoint uses AI to read messy handwriting, photos and files. AI extraction is not perfect and can misread text, numbers, quantities and prices. That's exactly why the review screen exists.
- You must review and verify every document — especially all figures, quantities, dates, VAT and totals — before sending it to anyone. Although we recalculate totals and tax in our own code (we never trust the AI's arithmetic), the underlying values come from what the AI read from your input, which you are responsible for checking.
- AI-generated drawings are illustrative representations, not certified plans, engineering documents or as-built drawings. Don't rely on them for construction, regulatory or safety-critical decisions without independent professional verification.
- Ballpoint does not provide legal, tax, accounting or financial advice. Documents you create with it (including any embedded terms and conditions) are your responsibility, and you should get professional advice where it matters.
You are solely responsible for the documents you send and for any decisions made based on Ballpoint's output.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or complete. Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, Ballpoint will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill, or data, arising from your use of (or inability to use) the Service — including any errors in AI-extracted or AI-generated content, or any documents you send.
To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits any liability that cannot legally be limited, including your statutory consumer rights where they apply.
10. Termination
You can stop using Ballpoint and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully. Where practical, we'll aim to give you notice and a chance to export your content first. Your right to export your data before deletion survives termination.
11. Governing law
These Terms are governed by the laws of [PLACEHOLDER: governing-law jurisdiction], and the courts of [PLACEHOLDER: governing-law jurisdiction] will have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
12. Changes to these Terms
We may update these Terms from time to time. We'll change the "Last updated" date and, for material changes, give reasonable notice in the app. Continuing to use Ballpoint after changes take effect means you accept the updated Terms.
